1. Acceptance of These Terms
These Terms of Service ("Terms") govern your use of the Kipply app for iPhone and iPad ("Kipply" or the "App") and of the Kipply Pro subscription. Kipply is developed and provided by Cirjan Darius ("we", "us" or "our").
By downloading, installing or using Kipply, or by buying Kipply Pro, you agree to these Terms. If you do not agree, please do not use the App.
2. Who Can Use Kipply
You must be at least 13 years old to use Kipply. If you are under the age of majority where you live, you may use Kipply only with the permission of a parent or guardian, who should also make or approve any purchase.
Kipply has no account and no sign-in. You are responsible for your device and for the Apple Account used to download the App and buy Kipply Pro.
3. What Kipply Does
3.1 Photos and Videos Only
Kipply helps you review and clean up the photos and videos in your iPhone or iPad Photos library. You can swipe through them to keep or delete, and Kipply can suggest groups to review, such as duplicates, similar shots, screenshots and videos.
Kipply works only on the photos and videos in your Photos library. It does not clean caches, app data, other apps' files or system storage.
3.2 Access to Your Photos
Kipply needs access to your Photos library to work. You grant that access through iOS and can change it at any time in Settings. Your photos and videos are analysed on your device and are never uploaded by Kipply. Our Privacy Policy explains what data the services inside the App receive.
3.3 Suggestions and Estimates
Suggestions, such as which photos look like duplicates or which shot is the best in a group, are made automatically and can be wrong. Storage figures are estimates based on the size of the items you delete. Please review every suggestion before you delete anything.
4. Deleting Photos and Videos
4.1 You Decide What Is Deleted
Kipply never deletes a photo or video on its own. You choose what to delete, and you are responsible for those choices, including suggestions you accept.
4.2 How Deletion Works
- Items you choose to delete first go to Kipply's bin, the Deleted tab. They stay in your Photos library until you confirm, and you can restore them from the bin.
- When you confirm, iOS asks for your permission and moves the items to the Recently Deleted album in the Photos app. Apple normally keeps them there for 30 days, and you can recover them from that album during that time.
- After that, or if you empty Recently Deleted yourself, the items are permanently removed and cannot be recovered by Kipply or by us.
- If you use iCloud Photos, deletions apply to all your devices that use the same library.
4.3 Back Up First
We strongly recommend that you back up any photos and videos you want to keep before using Kipply, for example with iCloud or another backup service.
5. The Free Version and Ads
Kipply is free to download and use. The free version includes:
- A daily limit on how many photos and videos you can review in the swipe cleaner (currently 25 a day).
- A limit on how many items you can delete in one go from Smart Clean or Discover (currently 10). Larger selections can still be deleted in several smaller batches.
- Full-screen ads served by Google AdMob, shown when you open the App and at certain points while you use it.
We may change these limits. The limits that apply to you are shown in the App. Ads are never selected using your photos or videos. What the ad and analytics services receive, and how to change your choices, is explained in our Privacy Policy.
6. Kipply Pro Subscriptions
6.1 Plans and What Pro Includes
Kipply Pro is an optional, auto-renewing subscription sold through the Apple App Store. It is offered as:
- Kipply Pro Weekly: renews every week.
- Kipply Pro Monthly: renews every month.
While your subscription is active, Kipply Pro removes the daily swipe limit, removes ads and removes the limit on deleting many items at once.
6.2 Price
The price of each plan is shown in the App and on the App Store before you buy, in your local currency. Prices may vary by country and may change. Apple tells you about a price increase for an active subscription before it applies and, where required, asks for your agreement.
6.3 Free Trial
Kipply Pro may start with a free trial (currently 3 days) if you have not used a Kipply Pro trial before. Whether a trial is available to you, and its length, is shown in the App before you confirm. When the trial ends, your subscription starts and you are charged unless you turn off auto-renewal at least 24 hours before the trial ends. Any unused part of a free trial is forfeited when you purchase a subscription.
6.4 Payment and Automatic Renewal
- Payment is charged to your Apple Account at confirmation of purchase, or at the end of a free trial if you started one.
- Your subscription renews automatically for the same period unless auto-renewal is turned off at least 24 hours before the end of the current period.
- Your Apple Account is charged for renewal within 24 hours before the end of the current period.
6.5 Managing and Cancelling
You can manage or cancel your subscription at any time in Settings > your name (Apple Account, formerly Apple ID) > Subscriptions on your iPhone or iPad. Apple's guide is at support.apple.com/en-us/118428.
If you cancel, Kipply Pro stays active until the end of the period you have already paid for, and your subscription does not renew. Deleting the App does not cancel your subscription.
6.6 Refunds
All payments are processed by Apple, and we cannot issue refunds ourselves. Refunds are handled by Apple under its terms. You can request one at reportaproblem.apple.com.
6.7 Restoring Purchases
If you reinstall Kipply or use a new device with the same Apple Account, you can restore an active subscription with Restore Purchases in the App.
7. Right of Withdrawal for EU Consumers
7.1 Your Right
If you are a consumer living in the European Union, you generally have the right to withdraw from a contract made at a distance within 14 days, without giving a reason, under Directive 2011/83/EU on consumer rights.
7.2 Digital Content
For digital content that is not supplied on a tangible medium, article 16(m) of that Directive allows the right of withdrawal to end once supply has started, but only if you gave your prior express consent to supply starting within the withdrawal period and acknowledged that you would lose your right of withdrawal. The same rule is set out in the national laws that implement the Directive, including:

7.3 How This Applies to Kipply Pro
Kipply Pro is bought through the App Store, and Apple processes the order and your payment. Requests to withdraw from a purchase, and any resulting refunds, are therefore handled by Apple under its Media Services Terms and Conditions. You can make a request at reportaproblem.apple.com. If you start with a free trial, you can also cancel before the trial ends and you will not be charged.
Nothing in these Terms limits your right of withdrawal or any other right you have under mandatory consumer protection law.
8. Apple's Standard EULA and the App Store
Kipply is licensed to you, not sold. Your licence to use the App is Apple's Licensed Application End User License Agreement (the Standard EULA), and these Terms add the details that are specific to Kipply. If the two conflict, these Terms apply to the extent the law allows, and the terms below in favour of Apple always apply. Your use of the App Store, including your purchases, is also subject to Apple's Media Services Terms and Conditions.
Because you downloaded Kipply from the App Store:
- Agreement: These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
- Licence: You may use the App on Apple-branded devices that you own or control, as permitted by the App Store usage rules.
- Support: We, not Apple, are responsible for maintenance and support of the App.
- Warranty: If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation for the App.
- Claims: We, not Apple, are responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to meet legal or regulatory requirements, and consumer protection claims.
- Intellectual property: We, not Apple, are responsible for investigating and handling any claim that the App infringes a third party's intellectual property rights.
- Legal compliance: You confirm that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
- Third-party terms: You must comply with any applicable third-party terms when using the App, such as your mobile data agreement.
- Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Intellectual Property
Kipply, including its design, code, text, graphics and the Kipply name and logo, is protected by copyright, trademark and other intellectual property laws. These Terms do not give you any rights to them other than the licence to use the App.
Your photos and videos remain yours. Kipply does not claim any rights to them.
10. Acceptable Use
You agree not to:
- Copy, modify, distribute, sell or sublicense the App
- Reverse engineer, decompile or disassemble the App, except where the law allows it
- Bypass or tamper with the free limits, the subscription checks or the ads
- Generate fake ad impressions or clicks, or otherwise misuse the ads in the App
- Use the App for any unlawful purpose or in a way that could damage, disable or impair it
11. Privacy
Your use of Kipply is also governed by our Privacy Policy, which explains how the App handles your data, including the advertising, analytics and subscription services it uses.
12. Disclaimers
To the extent permitted by law, Kipply is provided "as is" and "as available". We work to keep the App reliable, but we do not guarantee that it will be free of errors or interruptions, that it will find every duplicate or unwanted item, or that it will free a particular amount of storage.
This does not affect your statutory rights as a consumer, including the legal guarantee that digital content and services conform to the contract.
13. Limitation of Liability
Nothing in these Terms limits or excludes our liability where the law does not allow it, including liability for death or personal injury caused by negligence, for fraud, or for intentional or grossly negligent conduct, or your mandatory rights as a consumer.
Subject to that, and to the extent permitted by law:
- We are not liable for the deletion of photos or videos that you chose to delete, including suggestions you accepted.
- We are not liable for loss of data that a backup would have prevented.
- We are not liable for losses that were not reasonably foreseeable, or for loss of profit or business, as Kipply is intended for personal use.
- Our total liability for all claims relating to Kipply is limited to the amount you paid for Kipply Pro in the 12 months before the claim arose.
14. Ending Your Use of Kipply
You can stop using Kipply at any time by deleting it from your device. Deleting the App removes Kipply's own data on your device, such as the list of items in its bin, your statistics and your preferences. Items that were only in Kipply's bin stay in your Photos library. Deleting the App does not cancel a Kipply Pro subscription. See section 6.5.
We may suspend or end your right to use Kipply if you seriously or repeatedly break these Terms, for example by misusing the ads. Sections that by their nature should continue, such as sections 12, 13 and 16, continue to apply.
15. Changes to Kipply and to These Terms
We may update Kipply, add or change features, and change these Terms. When we change these Terms, we will post the new version on this page and update the "Last Updated" date. If a change materially affects you, for example your subscription, we will tell you in the App or in the App Store update notes before it takes effect.
If you do not agree to the changed Terms, stop using Kipply and cancel your subscription before it renews. Continuing to use the App after the changes take effect means you accept them.
16. Governing Law and Disputes
16.1 Governing Law
These Terms are governed by the laws of Romania, without regard to conflict of law principles. If you are a consumer in the European Union, the mandatory consumer protection laws of your country of residence also apply.
16.2 Resolving Disputes
If you have a problem with Kipply, please contact us first at iosallapps@icloud.com so we can try to resolve it in good faith. If it is not resolved within 30 days, the dispute may be submitted to the competent courts in Romania or, if you are a consumer in the European Union, to the courts of your place of residence.
17. Severability and Entire Agreement
If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full force and effect.
These Terms, together with our Privacy Policy and Apple's Standard EULA, are the entire agreement between you and Cirjan Darius regarding Kipply.
